Energiekern GmbH is the authorized distributor of KAN Battery for Europe – one of the leading lithium battery manufacturers in China with 27 years of experience, over 200,000 m² of production area and more than 50 technical patents.

Our team accompanies you from the first consultation through successful commissioning – for solutions ranging from home storage to megawatt systems.

Since 2025, Energiekern GmbH is also a distribution partner of Kingor Battery (Hangzhou Kaige New Energy Technology Co., Ltd.), a subsidiary of KAN Battery focused on battery systems for AGV/AMR, commercial storage and home storage.

§ 1 Scope

These GTC apply to all contracts between Energiekern GmbH, Profilstraße 8, 58093 Hagen (hereinafter “Seller”) and its customers. Deviating conditions of the buyer are not recognized unless the Seller agrees in writing.

§ 2 Conclusion of contract

Product representations on this website are not binding offers. The contract is concluded by written order confirmation of the Seller.

§ 3 Prices and payment

The prices stated in the offer apply plus statutory VAT. Invoices are payable within 14 days without deduction.

§ 4 Delivery

Delivery dates are non-binding unless expressly designated as binding. Delivery is ex works (EXW Hagen, Incoterms 2020). The transport risk passes to the buyer upon handover to the carrier.

§ 5 Retention of title

The delivered goods remain the property of the Seller until full payment.

§ 6 Warranty, Guarantee, Commissioning and Liability

Statutory warranty rights shall apply unless otherwise agreed on an individual contractual basis.

Energiekern GmbH is liable under statutory provisions for the defect-free nature of the products supplied by it as well as for the agreed technical product function within the specifications provided by the manufacturer.

Any product guarantees shall be governed exclusively by the guarantee conditions of the respective manufacturer, in particular KAN Battery Co., Ltd. The customer's statutory warranty rights against Energiekern GmbH remain unaffected.

Planning, installation, electrical connection, grid connection, parameterization, commissioning, official registration, fire safety inspection, site inspection, maintenance and instruction are not part of the product delivery unless they have been expressly commissioned and confirmed in writing by Energiekern GmbH.

If these services are provided by a specialist company, installer, electrician, planner or other third party commissioned by the customer, this third party is liable for the proper execution of its services. Energiekern GmbH shall not be liable for damage, functional failures, outages, consequential damage or safety risks attributable to faulty planning, installation, parameterization, commissioning, maintenance, operation, site conditions or the use of non-approved components.

The customer is obliged to use the products exclusively for their intended purpose and in accordance with the technical documentation, manufacturer specifications, safety regulations, operating instructions and applicable legal and technical requirements. Installation, connection, commissioning and maintenance may only be carried out by qualified and authorized persons.

Energiekern GmbH is liable without limitation in the event of intent and gross negligence as well as for damage resulting from injury to life, body or health, insofar as these are based on a breach of duty by Energiekern GmbH, its legal representatives or vicarious agents.

In the event of slightly negligent breach of essential contractual obligations, Energiekern GmbH is liable only for typical, foreseeable contractual damage.

Liability under the Product Liability Act and other mandatory statutory liability provisions remains unaffected.

Otherwise, liability is excluded.

§ 7 Returns and cancellation

Returns require prior written approval by the Seller.

§ 8 Applicable law and jurisdiction

German law applies. Exclusive place of jurisdiction is Hagen, provided the buyer is a merchant.

§ 9 Severability

Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
